Facebook has clear expectations of you and your business when you use their platform to collect user data (whether you collect data directly or indirectly (for example through use of a pixel)). Of the utmost importance is clause 5.7 of the Facebook Statement of Rights and Responsibilities (SRR), which states:

If you collect information from users, you will: obtain their consent, make it clear that you (and not Facebook) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it.

These requirements apply to all businesses big and small that collect data through Facebook.

How do you write a Facebook compliant Privacy Policy?

To get the right privacy policy in place for your business, you’ll need to have read and understood Facebook’s requirements. These include:

  1. Facebook Statement of Rights and Responsibilities (SRR) at Point 5: Applies when you collect information from a user, requiring a link from your Facebook post to the privacy policy hosted on your website.
  2. Facebook Terms for Conversion Tracking, Custom Audiences from Your Website, and Custom Audiences from Your Mobile App: Applies when collecting information using a Facebook tool such as Pixel.
  3. Facebook Pages Terms: Applies to business pages. Similar to the SRR requirements.
  4. Facebook Advertising Policies: Regulates the way you use data collected through Facebook ads.

You’ll also be required to agree to Facebook Terms and Conditions when posting sponsored content or ads. By going ahead with an ad or sponsored content, you agree to Facebook’s above guidelines. Importantly, you’ll be agreeing that you have a fully compliant privacy policy in place.

If you fail to have a privacy policy in place then Facebook may take down your business page under section 14 of the SRR.

Further, you may be required by Facebook’s SRR to comply with Australian laws which in some cases means you must comply with the Privacy Act (Cth) 1988. The Privacy Act applies if your business has an annual turnover of $3 million or more, or you provide a certain kind of service (such as a health service).
